Data Processing Agreement

1. Introduction

This Data Processing Agreement ("DPA") forms part of the Terms of Service between SmartJungle ("Processor") and you ("Controller") and governs the processing of personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

2. Definitions

Terms used in this DPA shall have the meanings set forth in the GDPR, including "Personal Data," "Processing," "Controller," "Processor," and "Data Subject."

3. Scope and Purpose

SmartJungle will process personal data only:

  • On documented instructions from the Controller
  • For the purpose of providing our services
  • In accordance with applicable data protection laws

4. Data Security

SmartJungle implements appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including:

  • Encryption of personal data in transit and at rest
  • Regular security assessments and audits
  • Access controls and authentication mechanisms
  • Incident response and breach notification procedures

5. Sub-Processors

SmartJungle may engage sub-processors to assist in providing services. We maintain a list of current sub-processors and will notify you of any changes.

6. Data Subject Rights

SmartJungle will assist the Controller in responding to data subject requests, including requests for access, rectification, erasure, restriction, and data portability.

7. Data Breach Notification

SmartJungle will notify the Controller without undue delay upon becoming aware of a personal data breach affecting the Controller's data.

8. Data Retention and Deletion

Upon termination of services, SmartJungle will delete or return all personal data to the Controller, unless required by law to retain such data.

9. Audit Rights

SmartJungle will make available to the Controller information necessary to demonstrate compliance with this DPA and allow for audits.

10. International Data Transfers

Any transfer of personal data to countries outside the EEA will be subject to appropriate safeguards as required by applicable data protection laws.
